Copyright policy
1. What sellers may post
Sellers own their listings and are responsible for them. Post only photos and video you took yourself, or that you have permission to use, such as from the photographer you hired or a manufacturer that licenses its images to dealers. Don't copy photos from other listings, other websites, social media or brochures. Photos must show the actual boat for sale. Text follows the same rule: write your own description.
By posting, you confirm you have these rights and give us the licence described in our terms, which covers showing your listing on Keel & Hull and sharing it on our Facebook, Instagram and Pinterest accounts.
2. Report a copyright problem
If a listing uses your photos, video or text without permission, send us a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512). Use this form, or email the same details to our copyright agent.
3. What happens next
- We review complete notices within one business day.
- If it's valid, we take the listing down and keep it offline. We also delete any posts we made of it on Facebook, Instagram and Pinterest.
- We email the seller your name, the work you described and the links you reported, so they can fix the listing or respond.
- Incomplete notices can't be acted on. We'll tell you what's missing.
4. Counter-notices
If your listing was taken down and you believe that was a mistake, for example because you took the photos, you can send a counter-notice to our copyright agent. It must include:
- Your physical or electronic signature (typing your full name is enough).
- The listing that was taken down and the material in question.
- A statement, under penalty of perjury, that you believe in good faith the material was removed by mistake or misidentification.
- Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you're outside the United States, any judicial district where we may be found), and that you'll accept service of process from the person who sent the notice.
We forward complete counter-notices to the person who sent the original notice. Unless they tell us within 10 business days that they've filed a court action, we put the listing back within 10 to 14 business days. If you'd rather replace the photos, just reply to our takedown email and we'll clear the hold once they're replaced.
5. Repeat infringers
We close the accounts of people who repeatedly post material they don't have the rights to. An account with 3 valid takedowns in 12 months is closed, and we may close an account sooner for deliberate copying.
